The USCIS, on May 18, 2009, once again provided an update on the number of filings for H-1B petitions for the fiscal year 2010 program.
It announced that it has received approximately 45,500 H-1B petitions counting toward the Congressionally-mandated 65,000 cap. It continues to accept petitions subject to the general cap.
I can report personally that the most recent H-1B regular cap I-129 petition that I filed was filed on May 11 and it was approved on May 15 � premium processed.
Also, the USCIS announced that is has received approximately 20,000 petitions for aliens with advanced degrees, consistent with its prior update and it reconfirmed that it is still accepting advanced degree petitions because it assumes that not all the petitions it received are approvable.
It�s beginning to look like the cap isn�t going to be reached any time soon and, who knows, maybe not at all this fiscal year.

I have the following question reg. my wife's status.
1. i applied Green Card in EB3 category, i have my EAD but iam not using it and iam maintaining my H1b for my wife as she is in H4.
2. Meantime my company is processing EB2 for me and is in PERM stage and i have included my wife in the EB2 process.
Suppose if we apply a new H1b visa for my wife and because of the tough situation if that H1b petiton is denied for my wife, will there be any queries or any issues when my wife files I-485/EAD in EB2 . Also will it cause any serious delays or I-485/EAD might get rejected?

I am waiting on my AP for myself and wife. I am not sure for how long the AP is approved for. I saw that it is sent and I should be getting in a couple of days probably.
I also think that something should be done in order to get 3 year EAD/AP since the approval process is taking longer.

For what could become the third year in a row, the Senate on Tuesday evening did not pass an Intelligence Authorization Bill, over the objection of a lone Republican senator whose name is being protected by his colleagues.
John D. Rockefeller IV (D-W.Va.), chairman of the Senate Select Committee on Intelligence, called the delay "one of the more embarrassing efforts I have been associated with in my 24 years in this body." The panel's vice chairman, Sen. Christopher S. Bond (R-Mo.), took the Senate floor Tuesday and called on "any person who has a hold on this bill to come forward and find out what is in the bill."
Rockefeller and Bond have been working over several months to meet objections to items in the bill that the committee passed last May. With changes that Rockefeller and Bond worked out, the measure was reintroduced Jan. 27 and put on the unanimous consent calendar on Feb. 8.
Sen. Jim DeMint (R-S.C.), a member of the Foreign Relations Committee, was named by Congressional Quarterly yesterday as the member who put the bill on hold. A DeMint spokesman said the senator's office "does not comment on holds," but other congressional sources said that DeMint was the one.
Those sources said that they believe the hold is due to White House objections to specific provisions, including public disclosure of the national intelligence budget; a requirement for a report on secret CIA prisons; and response to information requests by the committee chairman and vice chairman within 30 days.
"We have to be able to pass authorization bills if we are to have an impact on the intelligence community," Bond said.

I have my H1B visa with NIIT. My petition and visa for the first 3 yr period expire in October 2008. I am returning to India in April '08 to do my MBA, and will resign from NIIT, and therefore will not be able to renew my visa.
If I want to work in the US after I graduate, say in August '09, can an employer file a transfer petition based on this visa? Or Will they have to file for a new one under the quota? And if so, is there a way that I can hang on to my H1 status?

They might increase the no. of H1Bs but might not do any refinement in the immigration process I guess.:o

Hi,
Im having my H1B and 140 approved with my current employer. Now I got into a situation where in I need to file a new H1B with a new employer through whom im working on a project.But once my H1B is approved, my new employer will dismiss/cancel the new H1b Filed, as they just need to show that they filed a H1B for me.
Will this be a problem for my current 140 and GC processing or my existing H1B?
Coz that Im not going to use my new H1B, I can still continue using my current I94 right!
Any issues if my new H1b gets rejectd or queried!

Hi,
I was an employee with company A till march 2008 and i kept a H1b transfer to
company B on march 24th 2008. I was working to company B for an year
on receipt number applied for h1b transfer at USCIS. I got an RFE with
company B in sept 2008 mean while my I-94 got expired on August 2008.
Company B answered the RFE and submitted to USCIS on October 2008.
After waiting for H1B transfer to get approved it got denied on march 10th
2009.
Now i wanted to change my status from H1b to F1(CPT). My questions are
1. If i apply for transfer from H1B to F1 will i be getting New I-94 from
USCIS?
2. Should i be going back to india for getting stamped after i change my
status to F1 ?
3. Can i be on a student status from the day i receive the receipt notice
from USCIS for change of status ?
I would really appreciate your help regarding this issue..

Hi,
I filed for H1 petition in August 2009 and it is still pending. Meanwhile I applied for another H1B through a new employer (new employer took over my previous employers business) with premium processing. My latest H1B petition is denied citing Employee-Employer relationship discrepancies.
My attorney basically submitted documents similar to what he did for all other employees but they all got approved. I dont know what went wrong in my case.
I have a Master degree in Computer Engineering from a reputed school in this country as well. Please tell me what my options are to get back into H1B status and start working again.

what is the best way to do a change of address with uscis for pending applications ? I tried online changing ar-11 and for each individual case nothing seems to be getting in effect, my FP notice still gets forwarded to the old address. I also even called the uscis customer service and changed it , still no luck. any one had similar experiences ? please advise on what to do .
