    All these companies take people on H1 and after an year of year an half they say they have changed policy and they can't file H1. They have big lawyers like M**** and R**** and those lawyers tell employers even if your employee is on 5th year and if you don't file GC (PERM) b4 365 days its alright.... we can send them out and re catpture time and all BS and ultimately employees suffer.... as they r in their 5th or some are in 6th year and are completely screwed up.
    We should think of taking some legal actions...

    Overall, it is better if this bill dont pass:
    1. It makes LC very very difficult
    2. It brings illegals who apply infront of legals who apply after the bill passes. So, the backlog will be infinite.


    So, in all maybe it is better if this bill fails. It is good for illegals and bad for legals.

Question is when IV has already collected money for FOIA request than why it is not proceeding in that direction ? We get it in time or not is not the question now....

    Impact of rule 2 will be minimal and that rule will be really used not to displace
    US workers if that is the purpose. If companies are not really displacing US workers why should they bother about this rule? This rule will certainly minimise the outsourcing by laying off people as H1b persons are required for offshore co-ordination.

    Rule 3 is putting ad that is just like a Labor process in green card. It will delay h1b hiring for a month and really impact will be minimal

    Those 2 rules are worth if companies can get best people in the world(that was the intention of H1b program. That is what Google and Microsoft are arguing)

    If by reiterating (over and over) the "evilness" of "desi" companies insofar as impacting American workers is concerned and justifying absurdly and obviously restrictionist bills on the fond hope that it would have minimal impact on the "good" American companies who hire H1s in the exception, you wish to make it clear that you are an employee of the latter set of companies, you have certainly made your point, and do not need 364 posts to hammer it it.
    Ladies and gentlemen, Senthil is a genuine, bona fide high skilled person working for an honest American company which has high ethical standards, and is not, repeat, NOT displacing any son of the soil American.

    This is not new but only Lawyers and the employers who filed your GC knows what position and job duties on which they applied your GC.
    Position and job duties on which they applied your GC = whatever they said in your PERM/ labor cert application. If they make a change to that during the I-140 or I-485 stage, that itself will lead to RFE, if not to rejection! Some of us may not have the copy of the labor cert/PERM approval, but if so, one should try to look for the form that you (hopefully) reviewed during the first stage. For PERM this is ETA form 9089.

    :D I can understand your frustration and I am also surprised by the very slow response. As crucial as this year is for immigration reform, if members aren't committed for immigration reform and aren't helping monetarily and every other way possible, the GC saga will continue for years to come.

    I thought everyone in this forum is high skilled and very well educated. Well that may be but if members who think that just checking this site for updates and not contributing for the cause in anyway will eventually bring the relief are not very smart, aren't thinking right.

    Hoping for the best and just checking updates isn't the answer to retrogression; contribution is.


    Yes it is upto members if they want this process to be like the greencard process and we can wait for years to get a bill passed. We represent a community of highly skilled and get paid above average (than average american) but If we want 20 opinions per month on what IV should focus on, we can get those right away. However $20 per month is difficult.

    They sent me a letter earlier asking for money to do the FOIA and asking for definition of Priority dates. I replied to that letter and recently I got response saying they have received my response and have all the answers for my FOIA request ( I believe they won't do anything unless they get money from me)

    That is a good question. And here is a reply to that.

    Why does IEEE oppose H1? Because its members do not like competition from people whose profile match IV members i.e. people on H1B. If IEEE would be in love with green card and people waiting on green card, they would not support John Miano and his testimony. IEEE-USA's memberships consist of middle aged racist engineers who cannot keep up with the competition from mostly Asian younger workers. In the 80s and 90s, they were talking about globalization and its benefits as they got a jump start to get most of the global work. Now, other people in other nations have caught up and same globalization is causing them to pee in their pants. They understand that globalization is good for the country and the society. But what is good for the nation is not always good for each and every individual. So to save their lazy ass, they now want protection from their government, without realizing that if they get the protection they are seeking, they will not be able to enjoy that protection for very long as the companies will be compelled to look for more efficient and cost effective ways to do work.

    Anyways, answer to your question is in your question i.e. How could someone be against H1b and for green card?
    are you aware of the fact that IEEE actually lobbied to get a special quota of H1B for US-educated folks? these folks who fill this 20K quota are foreigners and by your logic will definitely be competing against these "racist" ppl. Because of the principled stand IEEE has taken, it continues to have clout.

    Let us see the approvals trend till october. I am guessing the PD will move back to MID 2005 or 2004 by October for EB-2 India.

    I don't agree. It will stay same or forward in small increments with new fiscal yr numbers available. I am saying so because EB2 I stayed for such long at 04/07 and everyone knows fewer LCs were filed/approved between 04 and 05.

    Thread Starter - unless you tell EXACTLY which GC category you fall in, when exactly was it applied - is the employment based, family based or what........ur asking questions but tellt he TECHNICAL details of your case..rather than saying USCIS is bad etc.

    USCIS evaluates an application when they open it for the first time - if they saw ur application 6 years later and a single field were missing...u'll have to file again.

    To me it seems like - u were illegal when u filed becuase u came here for a month and instead filed for GC, which was not ur original intention.

    The work u do here will get u a job in canada easily. Tons of ppl are moving to canada from US just because of this crappy USCIS and GC process.

    Contact an attroney, if u dont have the money, request someone pro bono favor or contact some agency. I'm not sure if canadian consulate can help u.

    I had to reluctantly stay away from the rally due to a brand new baby at home, but I sure hope to be part of future efforts.

    And I totally agree that Legal is the keyword. Most Americans are not clear about Legals v Illegals and lump them together. Of course, some just do not care and do not see a need to differentiate between the two. They would just like to see Asian and South Asian folks get out of the country.

    And I also am not in favor of asking for an increase in GC quota. Instead I am in favor of not counting spouse and kids against the quota. This itself will effectively inrease the quota to over 350K per year. Directly asking for quota increase always leaves a bad taste for skeptics and will slow down any possible action.

    Sorry for asking too many questions. One more thing is when did you get this RFE? I am in similar situation---used AC-21 and applied for EAD back in first week of May 2008, but nothing yet from NSC. I was with my GC sponsoring employer for more than 6 months though and I-140 was approved back in 2005.

    I filed EAD renewal on May 28 2008.

    I do not think that copies of DL is necessary. Please double check with your attoney before sending them.
